Terms of Use

1. Who runs this site

This website is run by Aske Engineering, a sole proprietorship (enkeltpersonforetak) registered in Norway and owned by Adam Emile Aske. Organisation number: TODO. Contact: post@askeengineering.no.

2. NIRWizard is licensed separately

NIRWizard is free to download and use. Your use of the software is governed by the NIRWizard Software Licence Agreement, which ships with every download and is shown on first launch. In short, and without replacing the licence itself:

  • You may use NIRWizard for research, teaching, evaluation and private study, at a university, a hospital or a company, on as many machines as you like, and publish the results you get from it.
  • You may read, build and modify your own copy of the source code.
  • You may not redistribute NIRWizard, in source, binary or modified form, or sell it, run it as a paid service or build it into a product. Commercial licences are available on request.
  • NIRWizard is a research instrument, not a medical device. Do not use it to diagnose or treat anyone.

If anything on this site differs from the licence agreement, the licence agreement wins.

3. Downloads

Installers are published as GitHub Releases. Pre-1.0 builds are marked tester and have the licence key screen switched off. Unsigned installers may trigger operating-system warnings; check the file name against the release archive before running it.

4. In-app feedback

The Feedback menu in NIRWizard sends your message to Aske Engineering through this website. Don’t include patient data or other sensitive personal data in a report. See the privacy policy for how feedback is handled.

5. Earlier paid subscriptions

Before version 0.1.8, NIRWizard was sold as a subscription through Polar. Existing licence keys keep working. Questions about a past purchase or refund: post@askeengineering.no. TODO: confirm how remaining subscriptions are wound down.

6. Website content

The text, images and marks on this site belong to Aske Engineering unless stated otherwise. The Aske and NIRWizard names and marks may not be used in a way that suggests endorsement.

7. No warranty

The website is provided as is. NIRWizard’s warranty disclaimer and limitation of liability are set out in its licence agreement. TODO: confirm wording against Norwegian mandatory law.

8. Governing law

These terms are governed by the laws of Norway, with Oslo District Court (Oslo tingrett) as the agreed venue, matching the NIRWizard licence.

9. Changes

These terms may be updated. The date at the top shows the latest version.
